1. INTRODUCTION

In this document, references to “Wet Technologies”, “we”, “our” or “us” refer to WET Technologies Pty Ltd (Registration number: 2015/049461/07), situated at 25 Crompton Street, Gants Plaza, Cape Town 7140.

We are committed to processing personal information lawfully, reasonably and transparently. We will only collect and process personal information that is necessary for a specific, explicitly defined and lawful purpose related to our business activities.

Where personal information is required to comply with a legal obligation or to conclude or perform a contract, its provision is mandatory. Failure to provide such information may result in our inability to provide services or fulfil contractual obligations. Where information is requested for marketing or other optional purposes, its provision is voluntary.

2. WHAT IS PERSONAL INFORMATION

“Personal Information” as defined in POPIA means information relating to an identifiable, living natural person and, where applicable, an identifiable, existing juristic person. This includes, but is not limited to:

  • Employment, educational and medical history;
  • Biometric information;
  • Correspondence and opinions about a person;
  • Online identifiers and location information.

3. WHERE AND WHEN WE COLLECT PERSONAL INFORMATION

We primarily collect personal information directly from you when you:

  • Engage us for services;
  • Enter into a contract with us;
  • Communicate with us;
  • Visit our website;
  • Provide services to us as a supplier or contractor.

Where we collect personal information from a third party, we will take reasonable steps to inform you of the source of such information, unless an exception under POPIA applies.

We only collect personal information that is relevant and necessary for the purpose for which it is processed.

4. WHEN WE PROCESS YOUR PERSONAL INFORMATION

We process personal information only where one or more of the following lawful bases apply:

  • You have provided consent;
  • Processing is necessary to conclude or perform a contract with you;
  • Processing complies with a legal obligation;
  • Processing protects a legitimate interest of you, us, or a third party;
  • Processing is authorised by law;
  • Where the data subject is a child, consent has been provided by a competent person.

5. WHEN WE PROCESS SPECIAL PERSONAL INFORMATION

Special personal information includes information relating to:

  • Trade union membership;
  • Political beliefs;
  • Health or medical history;
  • Biometric information;
  • Criminal behaviour.

We will only process special personal information where:

  • Processing is necessary for historical, research or statistical purposes and adequate safeguards are in place;

  • Business registration number
  • VAT registration number
  • Business name / trading name
  • Banking details
  • Title and contact person details
  • Name and surname
  • Addresses

Website Visitors

Purpose of Processing:

  • Communication
  • Marketing (where consent has been obtained where required)

Information Collected:

  • Name and surname
  • Contact details
  • Location information
  • Other information voluntarily provided

Note: We limit collection to information necessary for each specific purpose.

7. HOW WE SHARE YOUR INFORMATION

Third parties:

We may also share your data with governmental agencies and regulators (e.g. tax authorities), insurance carriers, courts, and government authorities.

We may further, in the course of business, transfer your personal information to other group companies and/or service providers as part of our normal business operations to carry out certain contract management, service delivery e.g., lawyers, accountants, auditors.

All group companies and service providers are contractually required to implement appropriate security measures and maintain confidentiality in accordance with POPIA or equivalent legislation.

Legal Disclosures:

We may need to share your information when we believe it is required by law, legal process or to help protect the rights and safety of you, us, or others. We attempt to notify members about legal demands for their data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, at our discretion, that the requests are overbroad, vague, or lack proper authority, but we do not promise to challenge every demand.

8. YOUR RIGHTS AND OBLIGATIONS

You have the right to:

  • Request access to your personal information;
  • Request correction or updating of inaccurate or incomplete information;
  • Request deletion of personal information where legally permissible;
  • Object to processing based on legitimate interest or for direct marketing purposes;
  • Withdraw consent at any time (without affecting prior lawful processing);
  • Request restriction of processing in certain circumstances;
  • Lodge a complaint with the Information Regulator.

9. RETENTION OF RECORDS

We retain personal information only for as long as:

  • Necessary to fulfil the purpose for which it was collected;
  • Required to comply with legal or regulatory obligations;
  • Necessary to resolve disputes, prevent fraud, or enforce agreements.

Once information is no longer required, it will be securely deleted or destroyed in accordance with applicable laws and our Data Retention Policy.

10. CHANGES TO THIS PRIVACY NOTICE

We may modify this privacy notice from time to time, as required by changes in legislation. You acknowledge that your continued use of our services after we publish our changes to this privacy notice means that the collection, use, and sharing of your personal information is subject to the updated privacy notice.

Security

We implement appropriate technical and organisational measures to safeguard personal information against loss, misuse, unauthorised access, disclosure, alteration or destruction.

Access to personal information is limited to authorised individuals on a need-to-know basis.

Information and data may be collected automatically through server operations and cookies.

  • Facilitate access to the website
  • Track usage behaviour
  • Compile data for website improvements

Monitoring and Surveillance

CCTV footage is processed for security and crime prevention purposes in accordance with our Monitoring and Surveillance Policy.
